Terms of Service

These Terms of Service ("Terms") govern your access to and use of BeDrama, including the BeDrama mobile application, website, account portal, BD top-up pages, membership pages, AI character chat, AI content generation features, creator tools, series viewing, and related services (collectively, the "Service"). The Service is operated by Gripping Inc., doing business as BeDrama ("BeDrama," "we," "us," or "our"). By creating an account, accessing the Service, purchasing BD, starting a membership, publishing content, or otherwise using the Service, you agree to these Terms and our Privacy Notice. If you do not agree, do not use the Service.

BeDrama is an AI-powered interactive entertainment service where users can chat with fictional characters, make story choices, generate personalized AI drama scenes, create or publish characters, view series, and share drama moments. The Service may include:

• AI character chat
• Interactive storytelling
• AI-generated text, images, audio, video, clips, scenes, and drama cuts
• Character creation tools
• Public and private character features
• Series viewing
• Creator tools
• BD credits and BD top-ups
• Membership plans
• Community, sharing, reporting, and moderation features
• Web account and billing management features

We may add, modify, suspend, restrict, or discontinue features at any time, subject to applicable law.

You must be at least 13 years old to use the Service. If you are 13-17, you represent that you have permission from your parent or legal guardian to use the Service where required by applicable law. You may not use the Service if you are prohibited from doing so under applicable law, sanctions, export-control rules, platform rules, or these Terms. We may refuse, suspend, or terminate access if we believe you do not meet eligibility requirements.

We may request your date of birth or age-related information to verify eligibility and apply safety controls. Safe Mode is enabled by default. Users under 18 may not disable Safe Mode or access mature content. Users 18 or older may be allowed to disable Safe Mode only after confirming that they are at least 18, where such access is available. You may not misrepresent your age or attempt to bypass age gates, Safe Mode, parental controls, or content restrictions. The Service is not an adult service, dating service, sexual service, escort service, or real-person companionship service. BeDrama is an entertainment and storytelling service.

You may need an account to use certain features. Accounts may be created using Apple Sign In, Google Sign In, or another supported method. You agree to provide accurate information and keep your account information up to date. You are responsible for:

• Maintaining the security of your account
• All activity under your account
• Ensuring that you sign in with the same account used for purchases, memberships, BD balances, and app access
• Promptly notifying us of unauthorized access

Contact cs@gripping.ai if you believe your account has been compromised. We may suspend or terminate accounts that are inactive, fraudulent, abusive, or in violation of these Terms.

The Service is provided for entertainment, storytelling, creative, and social content purposes only. AI characters are fictional or simulated. They are not real people, professionals, therapists, doctors, lawyers, financial advisers, emergency responders, or human companions. You should not rely on AI characters, AI-generated content, or any Service output for medical, legal, financial, psychological, safety, emergency, or other high-stakes decisions. If you are in danger, experiencing a medical emergency, or considering self-harm, contact local emergency services or a qualified professional immediately.

"User Content" means any content you create, upload, submit, publish, share, save, generate, remix, or make available through the Service, including:

• Prompts
• Chat messages
• Character descriptions
• Character names
• Images, audio, video, clips, scenes, drama cuts, and thumbnails
• Storylines, settings, dialogue, and metadata
• Comments, likes, reports, and other user interactions
• Public or private characters
• Any content generated from your inputs

You are solely responsible for your User Content. You represent and warrant that:

• You own or have all rights, licenses, consents, and permissions necessary for your User Content
• Your User Content does not violate any law, regulation, contract, platform rule, or third-party right
• Your User Content does not infringe copyright, trademark, publicity, privacy, personality, moral, or other rights
• If your User Content includes a real person's name, likeness, image, voice, biometric identifier, personal information, or identity, you have obtained all legally required consents
• Your User Content complies with these Terms and our policies

BeDrama does not verify ownership, legality, accuracy, or rights clearance of User Content.

The Service may allow you to mark characters, scenes, or other content as public or private. Public content may be visible to other users and may be discovered, viewed, interacted with, shared, or used within the Service as permitted by Service features. Private content is intended to be accessible only to you or to users you authorize, but no system is completely secure and we cannot guarantee absolute confidentiality. You are responsible for choosing the appropriate visibility setting. We may review, remove, restrict, reclassify, or disable access to public or private content if we believe it violates these Terms, applicable law, platform rules, third-party rights, or safety standards.

You retain ownership of your User Content as between you and BeDrama, subject to the rights and licenses granted in these Terms and any rights owned by third parties. You grant BeDrama a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, process, modify, adapt, translate, display, perform, distribute, publish, create derivative works from, and otherwise use your User Content as necessary or useful to:

• Provide, operate, maintain, secure, and improve the Service
• Generate AI outputs and related content
• Display your content according to your visibility settings
• Enable sharing, remixing, publishing, and creator features
• Moderate content and enforce safety policies
• Provide customer support
• Process payments, transactions, refunds, disputes, and account requests
• Develop, analyze, and improve Service features
• Comply with law and protect rights

For User Content you make public, publish, share, or submit to public features, you also grant BeDrama the right to use, reproduce, display, distribute, and promote that content, including screenshots, previews, clips, thumbnails, and excerpts, in connection with operating, marketing, and promoting the Service. This license continues for as long as needed to provide the Service, support prior uses, maintain backups, resolve disputes, comply with law, and enforce rights. Some licenses may continue after account deletion as described in these Terms and our Privacy Notice. You waive, to the extent permitted by law, any moral rights or similar rights that would prevent BeDrama from using User Content as permitted by these Terms.

If you make User Content public or share it through the Service, you grant other users a limited, non-exclusive, non-transferable license to access, view, interact with, and use that content within the Service for personal, non-commercial purposes, as enabled by Service features. You understand that other users may save, screenshot, record, or share content outside the Service despite restrictions. BeDrama is not responsible for unauthorized use by other users.

AI outputs may be inaccurate, incomplete, unexpected, offensive, unsafe, low quality, or similar to existing content. BeDrama does not guarantee that AI-generated content will be:

• Accurate
• Unique
• Error-free
• Suitable for your intended purpose
• Available at all times
• Non-infringing
• Commercially usable
• Free from offensive or unexpected material

You are responsible for reviewing AI outputs before using, publishing, relying on, or sharing them. Subject to your compliance with these Terms and third-party rights, you may use AI outputs generated for you through the Service for personal, non-commercial entertainment and sharing purposes. Commercial use is not permitted unless BeDrama separately grants commercial rights in writing or the applicable feature expressly permits commercial use. BeDrama does not grant you rights in underlying AI models, software, characters owned by BeDrama or licensors, third-party intellectual property, or preexisting content used in the Service. Purchases, BD usage, and memberships provide access to Service features and tools. They do not guarantee any specific creative outcome, output quality, artistic style, plot result, continuity, likeness, image quality, video quality, or commercial success. Dissatisfaction with AI outputs does not entitle you to a refund except where required by applicable law or applicable platform policies.

The Service, including software, source code, user interface, designs, graphics, logos, trademarks, service marks, trade names, content libraries, characters owned or licensed by us, models, systems, algorithms, databases, and all related intellectual property, belongs to BeDrama or its licensors. You may not copy, modify, reverse engineer, scrape, extract, sell, license, distribute, or create derivative works from the Service except as expressly allowed by these Terms or applicable law. No rights are granted except as expressly stated in these Terms.

You may not use the Service to:

• Violate any law, regulation, platform rule, or third-party right
• Infringe copyright, trademark, trade secret, publicity, privacy, personality, moral, or other rights
• Upload or generate non-consensual intimate imagery or sexualized depictions of real persons
• Create, request, upload, or distribute sexual, exploitative, abusive, or suggestive content involving minors or anyone who appears to be a minor
• Create deceptive deepfakes or impersonations of real individuals without required consent
• Use a real person's likeness, voice, identity, or personal information without required rights and consent
• Harass, threaten, bully, defame, stalk, dox, exploit, or harm others
• Promote hatred, discrimination, violence, terrorism, extremism, or targeted harassment
• Encourage self-harm, suicide, eating disorders, or dangerous behavior
• Generate or distribute illegal, harmful, abusive, deceptive, or exploitative content
• Attempt to access mature content if you are under 18
• Bypass age gates, Safe Mode, technical restrictions, rate limits, cooldowns, or payment controls
• Scrape, crawl, harvest, reverse engineer, interfere with, or disrupt the Service
• Use bots, scripts, automated tools, or unauthorized APIs
• Resell, transfer, sublicense, rent, or commercially exploit accounts, BD, outputs, or Service access without authorization
• Launder funds, commit fraud, abuse promotions, manipulate purchases, or engage in chargeback abuse
• Upload malware, spyware, harmful code, or content that disrupts the Service
• Misrepresent your identity, affiliation, rights, age, or authority
• Use the Service to train competing AI models, scrape datasets, or build a competing service without our written permission

We may remove content, restrict features, suspend accounts, revoke access, or terminate accounts for violations or suspected violations.

We may, but are not obligated to, monitor, review, filter, remove, restrict, label, demote, or disable access to content at any time. We may use automated systems, human review, third-party tools, user reports, and safety signals to moderate content. You can report content or users through in-app reporting tools where available or by emailing cs@gripping.ai. We may take action based on reports, including removing content, limiting visibility, blocking users, suspending accounts, or reporting illegal activity to authorities. We do not guarantee that all objectionable content will be removed or that moderation actions will occur within a specific time. We are not your legal representative and do not adjudicate private legal disputes between users.

The Service may use virtual credits called BD. BD may be used to access certain features, including images, clips, drama scenes, character features, generation features, or other Service functionality. BD is not money, stored value, a bank account, cryptocurrency, security, financial instrument, gift card, or property. BD has no cash value and cannot be exchanged for cash, transferred, resold, withdrawn, refunded, or redeemed outside the Service except where required by law. We may offer different types of BD.

14.1 Permanent BD

"Permanent BD" means BD that is designated as non-expiring in the Service, including purchased BD and reward BD that we classify as Permanent BD. Permanent BD does not expire while your account remains active, except where access is lost due to account deletion, account termination, fraud, chargeback, legal requirement, or another circumstance permitted by applicable law. Permanent BD is used after Plan BD unless we state otherwise.

14.2 Plan BD

"Plan BD" means BD included as a membership benefit. Plan BD is added while your membership is active, according to the applicable plan terms. Unless otherwise stated, Plan BD is added monthly. Unused Plan BD expires at the end of each monthly credit cycle and does not roll over. Plan BD is used first. Permanent BD is saved for later. If your membership is cancelled, expires, is not renewed, is refunded, is charged back, or is terminated, unused Plan BD may expire or be removed as described in the Service and these Terms.

14.3 Reward BD

We may provide reward, bonus, promotional, or free BD. Reward BD may be classified as Permanent BD or may be subject to expiration, restrictions, limits, or promotional terms if clearly disclosed at the time of grant. We may modify, suspend, revoke, or limit promotional BD in cases of fraud, abuse, mistake, chargeback, violation of these Terms, or as permitted by law.

14.4 BD Usage and Balance

BD may be consumed when you submit a generation request, unlock a feature, create content, publish content, or perform another paid action. BD costs, feature access, cooldowns, generation limits, and BD usage rates may vary by feature, plan, content type, model, availability, region, or operational cost. We may change BD costs, feature availability, cooldowns, and usage rates prospectively at any time. If a generation request fails due to a technical error, we may, at our discretion or where required by law, restore BD, re-run the request, or provide another remedy. We may correct BD balances if we detect an error, fraud, refund, chargeback, unauthorized transaction, or misuse.

BeDrama may offer paid membership plans, such as Pro or Ultra. Memberships may include benefits such as:

• Monthly Plan BD
• Character chat benefits
• Access to series or content libraries
• Character creation or publishing benefits
• Generation-related benefits
• Cooldown-based access
• Premium or advanced features
• Other benefits shown at purchase

Membership benefits may vary by plan, region, device, platform, account status, and availability. Memberships provide access to ongoing Service benefits. They do not guarantee specific AI outputs, uninterrupted availability, or specific creative results. Unless otherwise stated, memberships automatically renew until cancelled. Before purchase, we will display the price, billing period, renewal terms, included benefits, and other material terms. Monthly memberships renew monthly unless cancelled. Annual memberships renew annually unless cancelled. If an annual membership includes monthly Plan BD, the Plan BD is added monthly and unused Plan BD expires at the end of each monthly credit cycle. You must cancel through the platform or payment method used to purchase the membership:

• Apple App Store purchases must be managed through your Apple account
• Google Play purchases must be managed through your Google Play account
• Web purchases, where available, may be managed through the BeDrama account portal or the payment processor flow

Cancelling a membership stops future renewals. You generally retain membership benefits until the end of the current paid billing period unless the platform, payment processor, or applicable law provides otherwise. Deleting the BeDrama app or deleting your account does not automatically cancel a subscription billed through Apple, Google, Stripe, or another payment provider. You are responsible for cancelling through the relevant platform or payment provider.

In-app purchases may be processed through Apple App Store or Google Play. Web purchases, where offered and permitted by law and platform rules, may be processed through Stripe or another payment processor. Prices are shown before purchase and may vary by country, currency, taxes, platform fees, promotions, exchange rates, and payment method. You are responsible for applicable taxes, fees, data charges, and currency conversion costs. We may change prices, plans, BD packs, benefits, and purchase options prospectively. Price changes for active subscriptions will be handled as required by the applicable platform, payment processor, and law. Purchases may be subject to the terms, policies, billing rules, refund rules, and dispute processes of Apple, Google, Stripe, or another payment provider.

Except where required by applicable law or applicable platform policies, all purchases are final and non-refundable. Refund requests for purchases made through Apple or Google are generally handled by Apple or Google under their policies. Refund requests for web purchases, where available, may be reviewed by BeDrama or the payment processor. We may deny refund requests where permitted by law, including where BD has been used, features were accessed, membership benefits were delivered, or the request is based solely on dissatisfaction with AI output quality. Purchases grant access to tools and features. They do not guarantee specific outputs, output quality, continuity, character behavior, artistic quality, generation speed, availability, or commercial usability. If you initiate a chargeback, dispute, reversal, or payment failure, we may suspend or terminate your account, remove credited BD, disable membership benefits, restrict future purchases, or take other steps to prevent abuse, subject to applicable law. Nothing in these Terms limits non-waivable statutory refund rights.

We may offer promotions, trials, discounts, bonus BD, coupons, or special offers. Promotional offers may be limited by time, account, region, platform, eligibility, payment method, or other conditions. Unless otherwise stated, promotional benefits have no cash value, are non-transferable, and may be modified or withdrawn as permitted by law. If a trial converts to a paid subscription, we will disclose the material terms before charging where required.

You may delete your account through in-app settings where available or by contacting cs@gripping.ai. Before deleting your account, you should:

• Use remaining BD
• Save content you want to keep
• Cancel active subscriptions through Apple, Google, Stripe, or the relevant payment provider
• Understand that deletion is generally irreversible

Upon confirmed deletion, we may remove or anonymize your account profile and disable access to your account, subject to legal, security, payment, fraud-prevention, backup, and dispute-resolution limitations. Account deletion may permanently remove access to unused BD, membership benefits, private content, characters, chats, generated content, and account history. Certain records may be retained as described in our Privacy Notice.

We may suspend, restrict, or terminate your account or access to the Service at any time if we believe that:

• You violated these Terms or our policies
• Your conduct may harm users, BeDrama, third parties, or the public
• Your account is fraudulent, abusive, or insecure
• You infringed rights or violated law
• You attempted to bypass payment, safety, technical, age, or access controls
• You initiated abusive chargebacks or payment disputes
• We are required to do so by law, platform rule, court order, or government request
• Continued access may create legal, security, reputational, or operational risk

Termination may result in loss of access to content, BD, membership benefits, and account data, subject to applicable law. We may also discontinue the Service or any feature at any time. If required by law, we will provide any required notice or remedy.

If you believe content on the Service infringes your copyright or other rights, contact us at cs@gripping.ai with:

• Your name and contact information
• Identification of the copyrighted work or rights allegedly infringed
• Identification of the content you claim is infringing
• A statement that you have a good-faith belief that the use is not authorized
• A statement that the information you provide is accurate
• Your physical or electronic signature

If your content was removed and you believe it was removed by mistake, you may submit a counter-notice where permitted by law.

The Service may rely on or link to third-party services, including Apple, Google, Stripe, cloud providers, AI providers, analytics providers, app stores, and external websites. We are not responsible for third-party services, terms, policies, content, security, availability, or payment decisions. Your use of third-party services is governed by their terms and policies.

If you download the Service from Apple App Store, Google Play, or another platform, your use may also be subject to that platform's terms, policies, and payment rules. If these Terms conflict with mandatory platform terms, the platform terms may control to the extent of the conflict. Apple, Google, and other platforms are not responsible for providing support for the Service unless required by their own terms.

If you access or download the Service from the Apple App Store, the following terms also apply to the extent required by Apple:

• These Terms are between you and BeDrama, not Apple.
• Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support services for the Service.
• If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to Apple's policies. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Service.
• Apple is not responsible for addressing claims by you or any third party relating to the Service, including product liability claims, legal or regulatory claims, or consumer protection claims.
• Apple is not responsible for investigating, defending, settling, or discharging any third-party intellectual property infringement claim relating to the Service.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

Our Privacy Notice explains how we collect, use, disclose, and protect personal information. By using the Service, you acknowledge our Privacy Notice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." BEDRAMA DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, RELIABILITY, AND QUALITY. WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE AT ALL TIMES
• AI OUTPUTS WILL BE ACCURATE, UNIQUE, APPROPRIATE, SAFE, NON-INFRINGING, OR SUITABLE FOR YOUR PURPOSES
• CONTENT WILL BE STORED OR AVAILABLE INDEFINITELY
• DEFECTS WILL BE CORRECTED
• THE SERVICE WILL MEET YOUR EXPECTATIONS
• ANY PARTICULAR CHARACTER, SCENE, OUTPUT, SERIES, FEATURE, OR MEMBERSHIP BENEFIT WILL REMAIN AVAILABLE

YOU USE THE SERVICE AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME DISCLAIMERS MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEDRAMA, GRIPPING INC., AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, CONTENT, GOODWILL, USE, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

EVENT GIVING RISE TO THE CLAIM; OR

THESE LIMITATIONS APPLY TO ALL CLAIMS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BeDrama, Gripping Inc., and their affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

• Your use or misuse of the Service
• Your User Content
• Your AI-generated content or use of AI outputs
• Your violation of these Terms
• Your violation of law or third-party rights
• Your unauthorized use of a person's name, likeness, voice, identity, or personal information
• Your infringement or alleged infringement of intellectual property, privacy, publicity, or personality rights
• Your fraud, misrepresentation, payment abuse, chargeback abuse, or security violations

We may assume control of the defense of any matter subject to indemnification, and you agree to cooperate with our defense.

Please read this section carefully. It affects your legal rights.

29.1 Informal Resolution

Before filing a claim, you agree to first contact us at cs@gripping.ai and attempt to resolve the dispute informally. Your notice must describe the dispute and the relief you seek. We will attempt to resolve the dispute in good faith. If the dispute is not resolved within 30 days after receipt of notice, either party may proceed as described below.

29.2 Binding Arbitration

Except where prohibited by law, you and BeDrama agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court. Arbitration will be administered by a recognized arbitration provider, such as JAMS or the American Arbitration Association, under applicable consumer arbitration rules, unless the parties agree otherwise. The arbitration will be conducted in English. The seat and venue of arbitration will be Delaware, United States, unless applicable law requires otherwise or the arbitrator determines that another location or remote proceeding is appropriate.

29.3 Exceptions

Either party may bring claims in small claims court where permitted. Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, account security, platform integrity, or unauthorized use of the Service.

29.4 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND BEDRAMA AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party's claim.

29.5 Jury Trial Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND BEDRAMA WAIVE ANY RIGHT TO A JURY TRIAL.

29.6 Opt-Out

You may opt out of arbitration within 30 days after first accepting these Terms by emailing cs@gripping.ai with the subject line "Arbitration Opt-Out" and your account email address. Opting out of arbitration does not opt you out of any other part of these Terms, including the class action waiver where enforceable.

29.7 Mandatory Consumer Rights

Nothing in this section limits rights that cannot be waived under applicable consumer protection laws. If you reside outside the United States, you may have rights to bring claims in your country of residence under mandatory local law. If any part of this arbitration section is found unenforceable, it will be severed or modified to the minimum extent necessary, and the remainder will remain in effect, except that if the class action waiver is found unenforceable for a claim, the arbitration agreement will not apply to that claim unless permitted by law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise. If arbitration does not apply, disputes will be resolved in the state or federal courts located in Delaware, United States, except where prohibited by applicable law.
