Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the BeDrama platform, including character chat, AI-powered content generation, video creation, sharing, purchase services, and any related sites or apps (collectively, the "Service") operated by BeDrama (Gripping Inc.) ("BeDrama," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an entity, you represent you are authorized to bind that entity.

2. Eligibility

  • You must be at least the age of majority in your jurisdiction, or have valid parental/guardian consent where permitted by law.
  • You are not barred from using the Service under any applicable law, and you have authority to enter into these Terms.

2.1 Age Assurance and Safety Controls

  • Signup requires birthdate to enforce minimum age and age-based protections; this information is not public and is used only for eligibility and safety controls.
  • Users under 13 cannot register, in compliance with COPPA (Children's Online Privacy Protection Act) and similar regulations.
  • Safe Mode (restricting mature/NSFW content) is enabled by default for all users.
  • Users under 18 cannot access mature content or disable Safe Mode. Adults must complete an additional 18+ confirmation before disabling Safe Mode.
  • If we discover that a user under 13 has registered, we will immediately delete their account and all associated data.

3. Account Registration and Security

  • You may need an account with accurate, current, and complete information.
  • You are responsible for safeguarding your credentials and all activity under your account.
  • Notify us promptly of unauthorized use at cs@gripping.ai.

4. User Content and Intellectual Property Responsibility

"User Content" includes any data, text, images, audio, video, prompts, characters, scripts, or other materials you provide, including assets for chat, AI prompts, and videos.

4.1 Representations

  • You own or have all necessary rights, licenses, and consents (including for derivative works) for each asset you upload.
  • If your content includes a person’s image, voice, name, or likeness, you have obtained required permissions for upload, in-Service use, and viewing/interaction by others.
  • You acknowledge BeDrama cannot verify ownership or legality of each asset; you are solely responsible for your User Content.

5. Responsibility for Copyright, Personality Rights, and Legal Compliance

  • You are fully responsible for any infringement, violation of personality/publicity rights, privacy violations, defamation, contractual breaches, or platform policy violations arising from your User Content.
  • You agree to comply with all applicable laws, including IP, privacy/publicity, and content regulations.

6. License Grant to BeDrama

By providing User Content, you grant BeDrama a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, modify, translate, distribute, transmit, display, perform, and otherwise use your User Content to operate, improve, market, and provide the Service (including AI outputs, streaming, previews, and promotion). This license persists while your content is available and, after account deletion, may continue as reasonably necessary for service integrity, backups, audits, legal compliance, and honoring prior uses/transactions to the extent permitted by law. You retain ownership of your User Content.

7. License Grant to Other Users

If you configure your User Content to be viewable/shareable/purchasable, you grant other users a limited, non-exclusive, non-transferable license to access, stream, display, and use such content within the Service for personal, non-commercial use, unless otherwise allowed by Service functionality or a separate agreement.

8. AI-Generated Content and Outcome Disclaimer

  • AI outputs may be incorrect, unexpected, offensive, or similar to existing works.
  • BeDrama does not guarantee uniqueness, quality, accuracy, or non-infringement of AI outputs.
  • You must review outputs and ensure your use complies with law and third-party rights.

9. Payments, Credits, and No Refund / No Outcome Guarantee

  • Fees/credits are non-refundable and non-cancellable unless required by law.
  • You pay for access to tools, not guaranteed creative results.
  • Unwanted or low-quality outputs do not entitle you to refunds or damages.

10. Monitoring, Moderation, and No General Duty to Monitor

BeDrama is not obligated to monitor all content but may review, filter, remove, or suspend content/accounts at its discretion, including immediate removal without prior notice if content violates these Terms or our policies. Infringing content may appear briefly before removal; efforts to moderate do not create additional warranties or duties.

10.1 Mature Content Exposure and Rating

  • Safe Mode is enabled by default; users under 18 cannot access mature content or disable Safe Mode, and adults must explicitly confirm 18+ status to view mature content.
  • Mature or suggestive themes are not part of the default experience and surface only after explicit user actions and eligibility checks.
  • Prior test builds temporarily relaxed filters to validate moderation/reporting; this configuration is not present in production.
  • Age rating selections have been corrected to “Infrequent” where applicable based on actual exposure.

11. Reporting Mechanism and Takedown Procedures

Report via in-Service “Report” or email cs@gripping.ai with details (content ID/URL, why it infringes, contact info, evidence). We may remove or restrict content, notify uploaders, request info, or take other actions at our discretion and as required by law. We do not act as your legal representative and do not guarantee timing or outcome.

12. Prohibited Conduct

  • Infringing IP or violating personality/publicity rights.
  • Defamatory, obscene, hateful, discriminatory, or unlawful content.
  • Deepfakes or deceptive content about real individuals without consent or in violation of law.
  • Bypassing security, using bots/scrapers without authorization, reverse engineering the Service or AI models.

13. Ownership of the Service

Except for User Content and AI outputs as between you and BeDrama, all rights in the Service (software, interfaces, designs, trademarks, logos, IP) belong to BeDrama and its licensors. No rights are granted except as expressly stated.

14. Disclaimers of Warranties

The Service is provided "as is" and "as available" without warranties, express or implied, including merchantability, fitness, non-infringement, or that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, BeDrama is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, or goodwill; or damages from use or inability to use the Service, AI outputs, or temporary display of infringing content. Aggregate liability is limited to the greater of (a) amounts you paid in the three months before the claim or (b) USD 100 (or equivalent). Some jurisdictions do not allow certain limits; limits apply to the fullest extent permitted.

16. Indemnification

You will indemnify and hold harmless BeDrama, its affiliates, officers, directors, employees, and agents from claims, damages, and expenses (including attorneys’ fees) arising from your use of the Service, your User Content or AI outputs, your violation of these Terms or law, or allegations that your content infringes third-party rights.

17. Gender and Content Preference Information

  • We may request gender identity or preferred character/content genders solely to personalize recommendations.
  • You may choose not to disclose; choosing “prefer not to say” will not limit core features (personalization may be less accurate).
  • Preference data is processed per our Privacy Notice and can be updated or deleted as allowed by law and Service functionality.

18. Termination and Suspension

We may suspend or terminate access, or remove content, without notice if you violate these Terms, if required by law, or if we discontinue the Service.

  • You may stop using the Service and request account deletion at any time through in-app settings or by contacting us at cs@gripping.ai.
  • Account deletion requests will be processed within 30 days of verification.
  • After deletion, you will not be able to recover your account, content, or data.
  • Certain information may be retained as required by law (e.g., transaction records, content licenses as described in Section 6).
  • Licenses granted under Sections 6 and 7 may continue as needed to support prior uses, fulfill transactions, or comply with law, even after account deletion.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the courts located in Delaware, and you consent to their personal jurisdiction.

20. Changes to the Terms

We may update these Terms and will revise the "Last Updated" date above and provide additional notice as required by law. Continued use after changes indicates acceptance.
